NGHỊ QUYẾT
Về số giờ làm thêm trong 01 năm, trong 01 tháng của người lao động trong bối cảnh phòng, chống dịch COVID-19 và phục hồi, phát triển kinh tế - xã hội

Căn cứ Hiến pháp nước Cộng hòa xã hội Chủ nghĩa Việt Nam;
Căn cứ Luật Tổ chức Quốc hội số 57/2014/QH13 đã được sửa đổi, bổ sung một số điều theo Luật số 65/2020/QH14;
Căn cứ Bộ luật Lao động số 45/2019/QH14;
Căn cứ Nghị quyết số 30/2021/QH15 ngày 28 tháng 7 năm 2021 Kỳ họp thứ nhất, Quốc hội khóa XV;
QUYẾT NGHỊ:
Điều 1. Số giờ làm thêm trong 01 năm
1. Trường hợp người sử dụng lao động có nhu cầu và được sự đồng ý của người lao động thì được sử dụng người lao động làm thêm trên 200 giờ nhưng không quá 300 giờ trong 01 năm, trừ các trường hợp sau đây:
a) Người lao động từ đủ 15 tuổi đến chưa đủ 18 tuổi;
b) Người lao động là người khuyết tật nhẹ suy giảm khả năng lao động từ 51 % trở lên, khuyết tật nặng hoặc khuyết tật đặc biệt nặng;
c) Người lao động làm nghề, công việc nặng nhọc, độc hại, nguy hiểm hoặc đặc biệt nặng nhọc, độc hại, nguy hiểm;
d) Lao động nữ mang thai từ tháng thứ 7 hoặc từ tháng thứ 6 nếu làm việc ở vùng cao, vùng sâu, vùng xa, biên giới, hải đảo;
đ) Lao động nữ đang nuôi con dưới 12 tháng tuổi.
2. Không áp dụng khoản 1 Điều này đối với trường hợp quy định tại khoản 3 Điều 107 của Bộ luật Lao động.
Điều 2. Số giờ làm thêm trong 01 tháng
Trường hợp người sử dụng lao động được sử dụng người lao động làm thêm tối đa 300 giờ trong 01 năm có nhu cầu và được sự đồng ý của người lao động thì được sử dụng người lao động làm thêm trên 40 giờ nhưng không quá 60 giờ trong 01 tháng.
Điều 3. Tổ chức thực hiện
1. Việc thực hiện quy định về số giờ làm thêm tại Nghị quyết này phải tuân thủ đầy đủ các quy định khác có liên quan của Bộ luật Lao động.
2. Khi tổ chức làm thêm giờ quy định tại khoản 1 Điều 1 của Nghị quyết này, người sử dụng lao động phải thông báo bằng văn bản cho cơ quan chuyên môn về lao động thuộc Ủy ban nhân dân cấp tỉnh theo quy định tại khoản 4 Điều 107 của Bộ luật Lao động.
3. Người sử dụng lao động có trách nhiệm áp dụng các biện pháp nâng cao năng suất lao động và các biện pháp khác nhằm giảm thiểu việc làm thêm giờ; trong trường hợp phải làm thêm giờ, người sử dụng lao động thực hiện các chế độ phúc lợi bảo đảm cho người lao động có điều kiện thuận lợi hơn so với quy định của pháp luật về lao động.
4. Chính phủ, Bộ Lao động - Thương binh và Xã hội và các Bộ, ngành, chính quyền địa phương, trong phạm vi nhiệm vụ, quyền hạn của mình, hướng dẫn, tổ chức thi hành Nghị quyết này.
5. Tổng Liên đoàn Lao động Việt Nam tăng cường tuyên truyền, thông tin, chỉ đạo, hướng dẫn công đoàn các cấp trong việc giám sát thực hiện Nghị quyết, bảo vệ quyền lợi của người lao động, thúc đẩy việc đối thoại, thương lượng và ký kết thỏa ước lao động tập thể, các thỏa thuận bảo đảm phúc lợi cho người lao động trong quá trình thực hiện Nghị quyết này.
6. Phòng Thương mại và Công nghiệp Việt Nam, Liên minh Hợp tác xã Việt Nam và các tổ chức đại diện của người sử dụng lao động khác tăng cường tuyên truyền, thông tin đến người sử dụng lao động để thực hiện Nghị quyết này, đồng thời bảo đảm hài hòa quyền và lợi ích giữa các bên trong quan hệ lao động, hỗ trợ và tăng cường các chế độ phúc lợi cho người lao động để cùng vượt qua khó khăn, góp phần phục hồi sản xuất, phát triển kinh tế - xã hội.
Điều 4. Hiệu lực thi hành
1. Nghị quyết này có hiệu lực thi hành từ ngày 01 tháng 4 năm 2022, trừ quy định tại khoản 2 Điều này.
2. Quy định tại khoản 1 Điều 1 của Nghị quyết này có hiệu lực thi hành từ ngày 01 tháng 01 năm 2022.

Nghị quyết này được Ủy ban Thường vụ Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XV, phiên họp thứ 9 thông qua ngày 23 tháng 3 năm 2022.

RESOLUTION
On employees’ overtime working hours per year and per month in the context of COVID-19 prevention and control and socio-economic recovery and development1
THE NATIONAL ASSEMBLY STANDING COMMITTEE
Pursuant to the Constitution of the Socialist Republic of Vietnam;
Pursuant to Law No. 57/2014/QH13 on Organization of the National Assembly which had a number of articles amended and supplemented under Law No. 65/2020/QH14;
Pursuant to Labor Code No. 45/2019/QH14;
Pursuant to Resolution No. 30/2021/QH15 of July 28, 2021, of the 1st session of the 15th National Assembly;
RESOLVES:
Article 1. Overtime working hours per year
1. If having demand and after obtaining their employees’ consent, employers may arrange overtime work for between over 200 hours and 300 hours per year for their employees, except:
a/ Employees aged from full 15 years to under 18 years;
b/ Employees being persons with mild disabilities who have lost 51% or more of their working capacity and employees being persons with serious or extremely serious disabilities;
c/ Employees performing heavy, hazardous or dangerous occupations and jobs or extremely hard, hazardous and dangerous occupations and jobs;
d/ Female employees from the 7th month of pregnancy, or from the 6th month of pregnancy for those working in highland, deep-lying, remote, border or island areas;
dd/ Female employees who are raising a under-12-month child.
2. Clause 1 of this Article shall not apply to the cases specified in Clause 3, Article 107 of the Labor Code.
Article 2. Overtime working hours per month
If having demand and after obtaining their employees’ consent, employers that are entitled to arrange overtime work for up to 300 hours per year for their employees may arrange overtime work for their employees for between over 40 hours and 60 hours per month.
Article 3. Organization of implementation
1. The application of the regulations on overtime working hours in this Resolution must fully comply with other relevant provisions of the Labor Code.
2. When organizing overtime work under Clause 1, Article 1 of this Resolution, employers shall send a written notice to specialized agencies in charge of labor affairs under provincial-level People’s Committees as specified in Clause 4, Article 107 of the Labor Code.
3. Employers shall apply measures to increase labor productivity and other measures to reduce overtime work; in case of necessity to organize overtime work, employers shall apply welfare policies so as to ensure that employees are entitled to better benefits compared to those prescribed by the labor law.
4. The Government, the Ministry of Labor, Invalids and Social Affairs, ministries, sectors and local administrations shall, within the ambit of their tasks and powers, guide and organize the implementation of this Resolution.
5. The Vietnam General Confederation of Labor shall increase public communication and information and direct and guide trade unions at all levels to supervise the implementation of this Resolution, protect employees’ interests, promote dialogues and negotiations and conclusion of collective labor agreements and other agreements to ensure welfare for employees during the implementation of this Resolution.
6. The Vietnam Chamber of Commerce and Industry, the Vietnam Cooperative Alliance and other representative organizations of employers shall increase public communication to provide information to employers for them to implement this Resolution and, at the same time, ensure the harmony of rights and interests between related parties in industrial relations, support and increase welfare benefits for employees to overcome difficulties, contributing to production recovery and socio-economic development.
Article 4. Effect
1. This Resolution takes effect on April 1, 2022, except Clause 2 of this Article.
2. Clause 1, Article 1 of this Resolution takes effect on January 1, 2022.
This Resolution was passed on March 23, 2022, by the Standing Committee of the XVth National Assembly of the Socialist Republic of Vietnam at its 9th session.-
